drinks-on-me (the "Service") is operated by DRINKS ARE ON ME LLC, a Florida limited liability company ("drinks-on-me," "we," "us," or "our"). By accessing or using the Service, you agree to these Terms of Service. If you do not agree, do not use the Service.
You must be at least 21 years of age to use the Service. By using it, you represent that you are 21 or older, that you have the legal capacity to enter binding contracts, and that you will use the Service in compliance with applicable law.
You identify yourself on the Service with your phone number. You are responsible for the security of your phone and of any codes or QR images delivered to it, and for keeping your contact information accurate and current.
You can send a drink ("gift") or a review-earned free drink ("regift") to another person by selecting them from your device contacts. By sending a drink, you represent that the recipient is at least 21 years old and is willing to receive it. The gift message is sent through your own messaging apps, not by us. A drink is non-transferable once it has been claimed.
Payments are processed by Stripe. For a purchased gift, your card is charged at the time of purchase. For brand-sponsored free drinks, you are not charged — the sponsoring brand funds the drink. When a drink is redeemed, the venue is paid for it through Stripe, less a platform fee retained by drinks-on-me. Any tip you add is paid through to the venue.
Brands and venues may offer free or promotional drinks as part of activations. These are subject to the terms set by the sponsoring brand or venue, including time limits and quantity caps. drinks-on-me is not responsible for the availability or fulfillment of any particular promotion.
You agree not to: harass, threaten, or send unwanted drinks or messages to anyone; send drinks to anyone who is under 21 or who has not consented to receive them; circumvent payment, redemption, or expiration mechanisms; reverse-engineer or interfere with the Service; or use the Service for any unlawful purpose.
drinks-on-me is a technology platform that facilitates gifting and redemption of drinks. We do not sell, prepare, serve, or deliver alcohol. All drinks are prepared and served by independent participating venues, which are solely responsible for their service decisions and for compliance with all applicable liquor-licensing and alcohol-service laws, including verifying age and refusing service where required.
Please drink responsibly, and never drive under the influence. If you or someone with you needs a safe ride home, use one.
The Service, its branding, logos, and content are the property of drinks-on-me and are protected by intellectual property laws. You may not use them without our permission.
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied. Because drinks are prepared and served by independent venues, drinks-on-me is not responsible for the quality, safety, or contents of any drink served.
To the maximum extent permitted by law, drinks-on-me will not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim will not exceed the amount you paid through the Service in the 12 months preceding the claim.
You agree to indemnify and hold harmless drinks-on-me from any claims arising out of your use of the Service or your violation of these Terms.
We may suspend or terminate your access to the Service at any time, with or without notice, including for violation of these Terms.
These Terms are governed by the laws of the State of Florida. Any dispute will be resolved in the state or federal courts located in Miami-Dade County, Florida.
We may update these Terms from time to time. We will post the updated version here, and your continued use of the Service after changes take effect constitutes acceptance.
