Program Description: drinks-on-me sends SMS messages to subscribers including gift drink notifications, drink redemption confirmations, and venue promotional offers from venues subscribers have engaged with or opted in to receive offers from.
Opt-In: By providing your mobile phone number to drinks-on-me through our app, website, or web form, you expressly consent to receive recurring automated text messages from drinks-on-me at the phone number provided. Consent is not a condition of any purchase.
Message Frequency: Recurring messages. Frequency varies, typically 1-5 messages per month per subscriber.
Message and Data Rates: Message and data rates may apply.
HELP: For help, reply HELP to any message, or contact us at support@drinks-on-me.com.
STOP / Cancellation: You can cancel the SMS service at any time. Reply STOP to any message to unsubscribe. After replying STOP, you will receive one final confirmation message and you will no longer receive SMS messages from drinks-on-me. To rejoin, sign up as you did the first time and drinks-on-me will start sending messages to you again.

By accessing or using drinks-on-me ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.
You must be at least 21 years of age to use the Service. By using the Service, you represent that you are at least 21 years old, that you have the legal capacity to enter binding contracts, and that you will use the Service in compliance with applicable law.
You identify yourself on the Service using your phone number. You are responsible for the security of your phone and any messages, codes, or QR images delivered to it. You agree to provide accurate and current contact information.
You may purchase drinks for other individuals ("recipients") by providing the recipient's phone number. By doing so, you represent that the recipient is at least 21 years old and has consented to receive a gift drink notification at that number. Gifts are non-transferable once claimed.
Payments are processed by Stripe. Your card is authorized at purchase and captured when the drink is served. If the drink is not redeemed before expiration, the authorization is released. Tips are added at the time of purchase and paid through to the venue.
Venues may offer promotional drinks (free or discounted). Promotions are subject to terms set by the issuing venue, including time limits and quantity caps. drinks-on-me is not responsible for promotion availability or fulfillment.
You agree not to: harass, threaten, or send unwanted messages; send drinks to recipients who have not consented or who are under 21; circumvent payment, redemption, or expiration mechanisms; reverse-engineer the Service; use the Service for any unlawful purpose.
The Service, branding, logos, and content are the property of drinks-on-me and protected by intellectual property laws.
The Service is provided "AS IS" without warranties of any kind. Drinks are prepared and served by independent venues; drinks-on-me is not responsible for the quality, safety, or contents of drinks served at participating venues.
Please drink responsibly. Do not drive under the influence.
To the maximum extent permitted by law, drinks-on-me shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Total liability for any claim shall not exceed the amount you paid in the 12 months preceding the claim.
You agree to indemnify and hold harmless drinks-on-me from any claims arising out of your use of the Service or your violation of these Terms.
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms.
These Terms are governed by the laws of the State of Florida. Disputes shall be resolved in state or federal courts located in Miami-Dade County, Florida.
We may update these Terms from time to time. Continued use after changes constitutes acceptance.
